Plaintiff’s claims against the Macomb County Sheriff’s Jail, Macomb County Prosecutor’s Office, and Macomb County Jail Nursing Staff must be dismissed because they are not legal entities capable of being sued. See, e.g., Watson v. Gill, 40 Fed. App’x 88, 89 Hughson v. County of Atrim, 707 F. Supp. 304, 306 Haverstick Enter. v. Fin. Fed. Credit, Inc., 803 F. Supp. 1251, 1256 , aff’d32 F.3d 989 . These Defendants are departments of the county and thus the county is the appropriate party to address Plaintiff’s suit. Watson, 40 Fed. App’x at 89. While Macomb County is not immune from suit, it is not liable for a constitutional violation inflicted by its employees or agents unless the alleged violation results from an official policy or custom of the county. Monell v. Dep’t of Soc. Servs., 436 U.S. 658, 690, 694, 98 S. Ct. 2018, 2035, 2037-38 Petty v. County of Franklin, Ohio, 478 F.3d 341, 347 . Plaintiff does not identify any custom or policy of Macomb County related to the alleged deprivations of his constitutional rights.

“This is just the tip of the iceberg,” said Ralph Roberts, a Macomb daily real estate broker and author of a book on mortgage fraud who tipped off authorities about the Omni National Bank case. “You’re going to be seeing more cases. When the economy suffers, people start to do bad things.”

Ralph Roberts, said people across the country told him they were victims of the scheme. Everyone I talked to lost everything they put in, said Roberts. It wasnt set up to make money. It was set up to make inner-city real estate broker, Delroy Davy money. Some related to Roberts that they were chauffeured around Atlanta on a tour bus that included a stop at Davys sprawling mansion.

Davy recruited straw buyers to obtain fraudulent loans. For years, Omni was a magnet for these so-called property flippers, some of whom made superficial repairs and then resold the homes at inflated prices.

“When people are trying to sell their homes and they have foreclosures on their street, it lowers their value and makes it harder to sell their home,” Roberts continued. “Some folks wont buy into a neighborhood with foreclosed homes. This is the spreading ripple effect.”

Judicial Foreclosure Clerks Deed

  • In a judicial foreclosure, the Land Contract seller, mortgagee or lien claimant files a complaint in Circuit Court after a default occurs.
  • The judge enters a foreclosure judgment, which allows the Land Contract seller, mortgagee or lien claimant to schedule a foreclosure sale.
  • A public auction is conducted. If a third party bids on the property, the highest bidder will be entered as the grantee on the Clerks Deed. If there is no bid, the Land Contract seller/mortgagee or lien claimant name is entered on the deed as grantee.
  • The redemption period is stated as the last day to redeem in the certificate signed by the deputy clerk , attached to the Clerks Deed. The redemption period may be 6 months from the date of sale or as set by the judge. The deed shall be recorded within 20 days after the sale. MCL 600.3232.

    Real property tax delinquency entails a three-year forfeiture and foreclosure process in Michigan.
