Who Could See My Bankruptcy
Millions of Americans file bankruptcy each year, and cases dont usually garner much public attention. Including those directly involved in your filing, heres who can see your bankruptcy.
- Your name will be entered into a PACER database when you file bankruptcy. Anyone with a PACER account can view this information for a small fee. Although anyone can open an account, creditors and your bankruptcy attorney are likely the only ones who will view this information.
- Your bankruptcy trustee, if assigned one, will have knowledge of this information as well. The trustee should not disclose your financial information to outside parties.
- It is possible that your name could appear in the local papers public notices section. Not all papers publish bankruptcy filings. You can check your local paper to see if your town does so.
- The Meeting of Creditors is a public hearing that anyone can attend. It would be unusual for anyone other than your bankruptcy attorney and creditors to attend.
- You will receive mail from the Bankruptcy Court. Your mail carrier or neighbors who see your mail could find out about your bankruptcy by seeing marked envelopes.
Are Bankruptcy Filings Public Record
It’s important to understand that everything filed in a bankruptcy case is a matter of public record . So technically, your bankruptcy filing would be available for viewing by anyone willing to go through the steps to see it. But, most people wouldn’t bother. Here’s why.
After filling out bankruptcy paperwork, your bankruptcy petition and schedules get filed in the bankruptcy court and the clerk uploads them into the Pacer system used by the Federal courts to store and access court documents. Everyone with Pacer access can search the system using various queriesincluding a nameto find and view bankruptcy filings and other legal documents.
Even though accessing Pacer isn’t tricky, you need a password to do soand few people other than bankruptcy attorneys need to use the system regularly enough to warrant getting a password.
Even so, it’s unlikely that a friend or coworker would inadvertently stumble upon your bankruptcy case. Not only would someone need to suspect that you filed, but that person’s curiosity would have to be strong enough that they’d be willing to spend time getting a password and becoming familiar with Pacer’s search features.
Keep in mind, however, that a few smaller jurisdictions publish bankruptcy filing notices online. And it’s possible that a few might publish filings in the local newspaper, too.

What Does Pacer Show
If you look up a particular bankruptcy case on PACER, you’ll be able to view the entire history of documents filed in the case from the beginning, including the bankruptcy petition and schedules and any motions, notices or orders filed by the debtor, the trustee, the creditors or the court. The list of documents and events, called a docket, provides a chronological list of all the things that happened in the case. You can also look at the list of creditors who filed claims in the case as well as all the attorneys who appeared in the case and other important information.
Most documents on PACER are in PDF format, so you’ll need a PDF reader to view them.
